ORDER

Heard the learned counsel for the petitioner and the learned Special Government Pleader for R1 to R3.

2. The petitioner is a resident of Narikudi Village. He alleges that the fourth respondent had committed encroachment on the petition mentioned tank bund.

3. The learned Special Government Pleader states that the encroachment committed by the fourth respondent was removed earlier on two occasions. But once again, the fourth respondent had put up fencing on the tank bund.

4. We direct the second respondent not only to remove the encroachment caused by the fourth respondent but also forfeit the materials and 2/4

also collect the damages from the fourth respondent. This shall be done by the second respondent within a period of four weeks from the date of receipt of a copy of this order.
