Criminal Original Petition filed under section 482 of Criminal Procedure Code, to direct the respondents to alter the appropriate offences against the accused persons in connection with the Crime No.59 of 2018 on the file of the second respondent police by considering the petitioner's representation, dated 09.06.2018.

O R D E R

This petition has been filed to direct the respondents to alter the appropriate offences against the accused persons in connection with the Crime No.59 of 2018 on the file of the second respondent police by considering the petitioner's representation, dated 09.06.2018.

2. The learned Government Advocate (Crl.side) appearing for the respondents would submit that after completion of investigation in Crime No.59 of 2018, the respondent police filed a charge sheet for the offences under Sections 294(b), 323 and 506(i) of IPC and the same was taken cognizance in S.T.C.No.412 of 2018 on the file of the learned Judicial Magistrate, Kamuthi.

3. Considering the above facts and circumstances of the case, the petitioner is at liberty to invoke provisions under Section 319 of Cr.P.C. to add the other offences by adducing evidence before the trial Court during the trial.
