Prayer: Writ Petition filed under Article 226 of Constitution of India, praying to issue a Writ of Mandamus, to direct the 3rd respondent to change the petitioner's granddaughter's name as Annrani Shine Hanini instead of Infant Rexia and change her father's name as Anthony Sahaya Surender instead of Surender in the Transfer Certificate based on her Birth Certificate dated 11.05.2012.

ORDER
This Writ Petition has been filed to direct the third respondent to change the petitioner's granddaughter's name as Annrani Shine Hanini instead of Infant Rexia and change her father's name as Anthony Sahaya Surender instead of Surender in the Transfer Certificate based on her birth Certificate dated 11.05.2012.

The learned counsel appearing for the petitioner would submit that the petitioner has made a representation to the first respondent on 03.04.2023 to change the name of his grand daughter as Annrani Shine Hanini instead of Infant Rexia and her father's name as Antony Sahaya Surender instead of Surender. However the same is yet to be considered. Hence, the present petition.

The learned counsel appearing for the third respondent would submit that no gazette publication was effected when the petitioner's granddaughter was studying in school and the representation was made only after she left the school. Had they effected gazette publication while studying in school, there is a possibility for the school authorities to effect the name change as sought for by the petitioner. Further, she would submit 2/5
that the Birth Certificate issued by the Rameswaram Municipality dated 17.08.2022 also mentions the name of the petitioner's granddaughter as Infant Rexia and her father's name as Surender. Hence, she prayed for dismissal of this Writ Petition.
4. When there are certain procedures stipulated, the petitioner has to follow the same. Gazette publication has to be effected for the purpose of name change. Without effecting gazette publication, they have made the representation for name change. The Birth Certificate dated 17.08.2022 and Transfer Certificate shows that the name of the petitioner's granddaughter is Infant Rexia. Therefore, unless and otherwise, Gazette Publication is effected, name cannot be changed as sought for by the petitioner.
