PRAYER IN AS(MD) No.72 of 2018 :

To prefer this Memorandum of grounds of First Appeal against the judgment and decree passed in O.S.No.82 of 2014 dated 03.11.2017 on the file of the Principal District Court, Tirunelveli. ORDER : This petition coming up for orders on this day, upon perusing the petition and the affidavit filed in support thereof and upon hearing the arguments of M/S.K.ESAKKI, Advocate for the petitioner, the court made the following order:- The appellant is the defendant. The suit has been filed for partition and separate possession of plaintiff's share in the suit property and it has been decreed. Aggrieved over that, the defendant has preferred an appeal and also filed this petition to stay all further proceedings in I.A. No. 45 of 2018 in O.S. No. 82 of 2014 which has been filed for passing of the final decree. Already the order has been passed on 09.01.2019 by granting interim stay for passing of the final decree alone. However, the other proceedings in I.A. No. 45 of 2018 are allowed to go on.
