Respondents PRAYER : Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Mandamus, restraining the respondents 2 to 4 herein from interfering with the rights of the parties which is of civil nature and further direct the respondents 2 and 3 to refer the complaint made by the fifth respondent, dated 22.04.2013, to the first respondent to enquire into the basic allegations contained in the said complaint based on the revenue records so as to pass appropriate orders in accordance with law.

ORDER

The present Writ Petition has been filed for a Writ of Mandamus, restraining the respondents 2 to 4 from interfering with the right of the parties on the strength of the complaint made by the fifth respondent herein. It is brought to the notice of the Court that, pursuant to the 2/5

complaint of the fifth respondent, an FIR had been registered. Challenging the FIR, Crl.O.P(MD)No.9235 of 2012 was filed and this Court by an order, dated 03.08.2018, had allowed the said criminal original petition, giving certain directions. Complaining that the order in the Crl.O.P(MD)No.9235 of 2012 was not complied with, the fifth respondent herein had also filed a contempt petition in Cont.P(MD)No. 1102 of 2019 and the same has also been closed by directing the District Administration to resume the encroached portion after following due process of law.

2. In the light of the above facts, I am of the view that, no further orders are required to be passed in the present writ petition. Hence, the writ petition stands closed. There shall be no order as to costs. Consequently, connected Miscellaneous Petition stands closed. 07.12.2022 Index :
