Respondents PRAYER : Writ Petition is filed under Article 226 of the Constitution of India praying to issue a Writ of Mandamus, directing the respondents herein to conduct survey, measurement and fix boundaries of the petitioner's property measuring 75 cents comprised in Survey Nos.870/1 & 871/2A1 situated in Thamaraikulam Bit-I, Periyakulam Taluk, Theni District, within a reasonable time. By consent of both parties, this writ petition is taken up for final disposal at the stage of admission itself. 2.The petitioner has made necessary payment seeking survey of his land, which she claims to be a patta land and which according to him, he has purchased by way of a registered sale deed, dated 11.12.2020.

3.As a matter of fact, my attention is drawn to the notice, dated 28.09.2021 issued by the Tahsildar, fixing 05.10.2021 as the date on which the survey would be conducted. The petitioner was not present. Notice had also been served on four other neigbouring land owners.

W.P(MD)No.20598 of 2021 4.Let the respondents issue a fresh notice to the petitioner and also to the said land owners and also to any other individual who might be interested directly or indirectly with the request given by the petitioner and thereafter, if there are objections, consider the objections and take a decision with respect to the representation given by the petitioner. The respondents are directed to comply with the request made in the representation within a period of twelve weeks from the date of receipt of a copy of this order.

5.With the above observation, the writ petition is disposed of. No costs.
