PRAYER :-For Bail in Crime No.722 of 2021 on the file of the Respondent police.
ORDER : The Court made the following order :- The petitioners/ Accused No.2 & 3, who were arrested and remanded to judicial custody on 06.10.2021 for the offence punishable under Section 366-A of IPC, in Crime No.722 of 2021 on the file of the respondent police, seek bail.
2. The case of the prosecution is that the first petitioner is the mother and the second petitioner is the elder brother of the first accused. On 17.09.2021, the first accused eloped with the daughter of the defacto complainant and the petitioners herein have helped them to their travel. Hence, this complaint. 3.The learned counsel for the petitioners would submit that the petitioners are innocent and they have not committed any offence as alleged by the prosecution. No.18060 of 2021 4.The learned Additional Public Prosecutor would submit that the petitioners have instigated the minor girl to go along with the first accused and that the minor girl yet to be secured and Habeas Corpus Petition is pending before this Court. 5.Considering the seriousness and gravity of the offence alleged and also considering the fact that the victim girl is yet to be secured, this Court is not inclined to grant bail to the petitioners at this point of time.
