O R D E R

This writ petition has been filed seeking the issuance of a writ of mandamus, directing the respondents 1 to 3 to conduct survey in the property is situated at Theni District, Theni Taluk, Jangulpatti Village in Survey No.126/4 and 129/1 total admeasuring 14 1/2 Acres and to issue a joint patta in the name of the living legal heirs of the deceased Narayanasamy Nayakkar and Velammal.

2. Heard the learned counsel for the parties and perused the materials available on record.

3.The learned counsel appearing for the petitioner submits that an application dated 21.10.2021 was made seeking a survey of the subject property. Since no action has been taken by the respondents, the present writ petition has been filed.

4. The learned Special Government Pleader appearing for the respondents submits that after considering the claims of all parties, appropriate steps would be taken on the application of the petitioner in accordance with Sections 9 and 10 of the Tamil Nadu Land Survey and Boundaries Act, 1923.

5. In view of the above, this Court directs the second respondent to consider and dispose of the petitioner's application dated 21.10.2021, on merits and in accordance with law. Notice shall be issued to the petitioner, respondents 4 to 19 and the owners of relevant adjacent lands and appropriate orders shall be passed in accordance with Sections 9 and 10 of the Tamil Nadu Land Survey and Boundaries Act 1923, within a period of twelve weeks from the date of receipt of a copy of this order. In the event of any rival claims, the same can be agitated before the competent civil court. No costs.
