Writ Petition filed under Article 226 of the Constitution of India, seeking for the issuance of Writ of Mandamus, to direct the respondents to remove the road laid down in Patta Lands belonging to the petitioner comprised in Survey Nos.382/1 and 389/6, Kamatchipuram Village, Dindigul Taluk, Dindigul District and restore the said lands to its original position within the period stipulated by this Court.

ORDER

The petitioner has approached this Court that the 3rd respondent, namely, the Divisional Engineer, Highways Department, NABARD and Rural and Village Rods Wing, Dindigul, has laid a thar road in his patta land, without acquiring his land under the Land Acquisition Act and therefore, he sought for a direction to remove the road laid down in his patta land.

2. Today, when the matter is taken up for hearing, the learned counsel appearing for the petitioner submits that the road, which has 2/4

been laid in the petitioner's patta land, has been removed.

3. However, the learned Special Government Pleader, on instructions, submits that the 3rd respondent has not laid any road in the petitioner's patta land.

4. Since the petitioner has taken a stand that the road claimed to have been laid has been removed, this writ petition is closed as no further order is required in this writ petition. No costs. 20.04.2023 ogy Index : Yes / No.
