For Respondent : Mr.R.MEENAKSHI SUNDARAM, Additional Public Prosecutor PETITION FOR BAIL Under Sec.439 of Cr.P.C PRAYER :- For Bail in Crime No.525 of 2021 on the file of the Respondent Police.

ORDER : The Court made the following order :- The petitioner/Accused, who was arrested and remanded to judicial custody on 02.10.2021 for the offence under Sections 4(1)(a), 4(1)(i) and 4(1-A) of Tamil Nadu Prohibition Act in Crime No.525 of 2021 on the file of the respondent police, seeks bail. 2.The case of the prosecution is that the petitioner and other accused were found in illegal possession of 159 numbers (180ml each) of TASMAC brandy liquor bottles and cash of Rs.7090/-. Hence, the complaint.

3.The learned counsel appearing for the petitioner would submit that the petitioner is innocent and he has not committed any offence as alleged by the prosecution. He would further submit that the petitioner is in judicial custody from 02.10.2021 and hence, he seeks for grant of bail.

4.The learned Additional Public Prosecutor appearing for the respondent police opposed for grant of bail on the ground that apart from this case, the petitioner was involved in 23 previous cases, https://hcservices.ecourts.gov.in/hcservices/ 1/2

CRL OP(MD). No.18021 of 2021 which are similar in nature and that the investigation in this case is yet to be completed.

5.Considering the seriousness and gravity of the offence alleged and also the fact that the petitioner is having 23 previous cases of similar nature, this Court is not inclined to grant bail to the petitioner at this point of time.
