Respondents PRAYER: Petition filed under Section 482 Code of Criminal Procedure, to withdraw the case in Crime No.71 of 2014 on the file of the Respondent No.3 and entrust the same to the Respondent No.4 for investigation of the case by the Competent Officer and file a final report before the Jurisdictional Magistrate within the time stipulated by this Court.

ORDER

The petitioner lodged a complaint with Thiruppathur Town Police Station in the year 2014 about the theft of 64 sovereigns of gold from her house.

Crime No.71 of 2014 was registered. Since the petitioner was not satisfied with the investigation, she filed Crl.O.P.(MD)No.22674 of 2015 seeking transfer of investigation. 2.This Court, by order dated 01.12.2015, directed that the second respondent will monitor the investigation and ensure that the final report will be filed within a period of two months. The final report was filed, but recording the fact the case was undetected. Thereafter, it was reopened and the case is pending at the same https://hcservices.ecourts.gov.in/hcservices/

stage. In the mean while, this criminal original petition has been filed seeking the very same relief.

3.I am of the view that transferring the case to CBCID at this point of time, is not going to serve any purpose. 4.The learned Government Advocate (Crl.side) that the police will not close the case as such and keep it open and as and when any new materials are brought to light, they will definitely take further action as per law.

5.Recording the said submission, this criminal original petition stands closed.
