For Respondent : Mr.R.MEENAKSHI SUNDARAM, Additional Public Prosecutor PETITION FOR ANTICIPATORY BAIL Under Sec.438 of Cr.P.C PRAYER :- For Anticipatory Bail in Crime No. 398 of 2021 on the file of the respondent Police.

ORDER : The Court made the following order :- The petitioner, who apprehends arrest at the hands of the respondent police for the offences punishable under sections 294(b), 387, 307, 506(ii) IPC, in Crime No.398 of 2021 on the file of the respondent police, seeks anticipatory bail.

2. The case of the prosecution is that the petitioner and the other accused abused the defacto complainant by using filthy language and also attacked him with weapons and tried to snatch a sum of Rs.500/-. Hence, this complaint.

3.The learned counsel for the petitioner would submit that the petitioner is innocent and he has not committed any offence as alleged by the prosecution.

He would further submit that co-accused was already released on bail by the Sessions Court, Tirunelveli. Hence, he seeks anticipatory bail to the petitioner. 4.The learned Additional Public Prosecutor would submit that the petitioner is having 9 previous cases. Out of 9 cases, 6 cases were already disposed of. Remaining 3 cases are pending and out of 3 cases, two cases are similar in nature and the investigation is not yet completed.

CRL OP(MD). No.18108 of 2021 5.Considering the seriousness and gravity of the offence alleged and also considering the facts that the investigation is not yet completed and that the petitioner is having previous cases, which includes two cases for similar offence, this Court is not inclined to grant bail to the petitioner at this point of time. 6.In the result, this Criminal Original Petition is dismissed. sd/- 29/11/2021 / TRUE COPY / / /2021 Sub-Assistant Registrar (C.S.)
