PRAYER: Criminal Original Petition filed under Section 482 Cr.P.C. praying to direct the 2nd respondent police to give adequate police protection to the life and limb of the petitioner and her family members from the troublesome act of the third respondent by considering the petitioner's complaint dated 10.09.2019 within in the period stipulated by this court.

ORDER

This petition has been filed seeking direction to direct the 2nd respondent police to give adequate police protection to the life and limb of the petitioner and her family members from the troublesome act of the third respondent by considering the petitioner's complaint dated 10.09.2019

2. The learned Government Advocate(Crl.Side) would submit that already civil dispute is pending between the petitioner and the third respondent . The third respondent filed a suit in O.S.No. 775 of 2005 before the Munsif Court, Madurai and the said suit was dismissed on 09.02.2015. Thereafter the third respondent filed an application for anticipatory bail, which is pending with the first appellate court. While being so, the petitioner lodged a complaint on 10.06.2017 and on the complaint lodged by the petitioner, the second respondent conducted enquiry and the same was closed as civil in nature and both the parties are advised to appear before the civil court for appropriate relief.

3. At this juncture, police protection cannot be granted, since civil case is pending between the petitioner and the third respondent. Hence this Criminal Original Petition is dismissed. However, petitioner is at liberty to work out his remedy before the civil court in the manner known to law.
