For Respondent : Mr.M.Vaikkam Karunanithi, Government Advocate (Crl.Side) PETITION FOR ANTICIPATORY BAIL Under Sec.438 of Cr.P.C PRAYER :- For Anticipatory Bail in Crime No.403 of 2022 on the file of the respondent Police.

ORDER : The Court made the following order :- The petitioner/A2, who apprehends arrest at the hands of the respondent police for the offence punishable under Section 379 IPC in Crime No.403 of 2022 on the file of the respondent police, seeks anticipatory bail.

2.The case of the prosecution is that on 21.08.2022 at about 03.50 p.m., the petitioner along with other accused have committed theft of two redmi mobile phones worth about Rs.14,700/- from the de-facto complainant's wife. Hence, the complaint. 3.The learned counsel for the petitioner would submit that the petitioner is innocent and he has been falsely implicated in this case.

CRL OP(MD). No.16867 of 2022 complainant's wife's two mobile phones worth about Rs.14,700/- and the same were not yet recovered. He would further submit that the the investigation in this case is still pending and the custodial interrogation of the petitioner is very much necessary in this case. 5.Considering the facts and circumstances of the case and also considering the fact that the custodial interrogation of the petitioner is required in this case, this Court is not inclined to grant anticipatory bail tot he petitioner.
