PRAYER: Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Mandamus, to direct the respondents 1 to 11, particularly the respondents 4, 6, 8 and 9 to retrieving the petitioner's family Panchamar lands of bearing survey Nos. 53/4, 53/7, 53/8, 53/9, 53/10, 53/17, 53/18, 61/3, 61/7 and presently these had been sub-divided as 53/4A, 53/7P, 53/8P, 53/9P, 53/10A, 53/17A and 17C, 53/18B, 53/18P, 61/3P and 61/7P situated at Porundhalur Village, Kulithalai Taluk, Karur District from the respondents 12 to 14 and other encroachers, who are not belonging to Schedule caste and consequently, issue Patta in the petitioner's family name.

By asserting that the lands in the survey numbers mentioned in the prayer of the Writ Petition are 'Panchamar' lands, the petitioner had submitted representations for the retrieval of such land. The present Writ Petition relates thereto.

Learned counsel for respondents 12 to 14 submits that the pendency of this Writ Petition is affecting the said respondents because the petitioner has been sending communications to the jurisdictional Sub Registrar and, thereby, preventing the above mentioned respondents from dealing with the property. He submits that he is agreeable to the conduct of an inquiry on an expedited basis by the Commissioner of Land Administration.

3. Learned Government Advocate has placed on record written instructions from the Tahsildar stating that the relevant lands are not 'Panchamar' lands as per the revenue records. Without prejudice, he submits that the Commissioner of Land Administration would pass orders on merits within four (4) months.

4. Accordingly, without making any observations on the merits, this Writ Petition is disposed of by directing the fourth respondent to consider and dispose of on merits the petitioner's representation dated 22.12.2022 within six (6) months from the date of receipt of a copy of 4/7

this order, after providing a reasonable opportunity to the petitioner and the private respondents herein. No costs. Consequently, connected miscellaneous petition is closed.
