PRAYER: Civil Revision Petition is filed under Article 227 of the Constitution of India to set aside the order passed in I.A.No.14 of 2024 in D.O.P.No.163 of 2020 on the file of the Family Court, Thoothukudi, dated 03.04.2025 by allowing this Civil Revision Petition.

O R D E R

This petition has been filed seeking to set aside the order passed in I.A.No.14 of 2024 in D.O.P.No.163 of 2020 on the file of the Family Court, Thoothukudi, dated 03.04.2025 by allowing this Civil Revision Petition.

2. The respondent herein filed a petition in D.O.P No.163 of 2020 seeking divorce against the first petitioner on the file of the Family Court, Thoothukudi. Pending the petition, the petitioners herein filed an interlocutory application in I.A.No.14 of 2024 before the trial Court, and the trial Court awarded a sum of Rs.8,000/- to the first petitioner vide order dated 03.04.2025. Challenging the same, the petitioners have filed this present Civil Revision Petition.

3. The learned counsel appearing for the petitioners would submit that this Court may grant interim maintenance to the child also. Accordingly, he prayed for allowing this petition.

4. Per contra, the learned counsel for the respondent submitted that the trial Court has already granted a substantial maintenance amount and therefore, no further interference is warranted.

5. This Court has considered the rival submissions and perused the records. Considering the status of the parties and the needs of the petitioner and the minor child, this Court finds it appropriate to enhance the maintenance amount.

6. Accordingly, the maintenance awarded by the Court below is modified as follows:

(i) The respondent is directed to pay a sum of Rs.8,000/- (Rupees Eight Thousand only) per month as maintenance to the first petitioner and Rs.7,000/- (Rupees Seven Thousand only) per month as maintenance to the second petitioner / minor child.

7. The above amounts shall be paid from 07.09.2025 onwards, on or before the 7th day of every English calendar month. The respondent is further directed to deposit the entire interim maintenance arrears amount as per the order in I.A.No.14 of 2024 in D.O.P.No.163 of 2020, within a period of eight

(8) weeks from the date of receipt of a copy of this order, and the first petitioner is permitted to withdraw the entire arrears amount. 3/5

8. In view of the above, the Civil Revision Petition stands disposed of. No costs.
