ORDER

The present Writ Petition has been filed for the issuance of a Writ of Certiorari, to quash the impugned order No.2217/A3/2022, dated 19.08.2022 passed by the 2nd respondent.

2. The contention of the petitioner is that he is a cultivating tenant, which right was made over from the original cultivating tenant. The original owner in the mean while has sold the property to the subsequent purchasers without intimating to the petitioner. Therefore, the petitioner is aggrieved. When the petitioner sought to cancel subsequent purchasers documents, the respondents have conducted an enquiry and confirmed the purchase made by the original owners. Therefore, the respondents have refused to cancel the made over document.

3. This Court is of the considered opinion that the said sale deeds cannot be cancelled. However, the petitioner has an appropriate remedy before the Revenue Court or the Civil Court and not before the registration authorities. Even the writ court cannot entertain this because it needs to 2/4

scrutinize the facts. Therefore, this Court is not inclined to entertain this writ petition.

4. Accordingly, this writ petition is dismissed. However, the petitioner is at liberty to challenge the impugned order before the appropriate Court, if so advised. There shall be no order as to Costs. Consequently, connected miscellaneous petition is closed.
