ORDER

(Order of the Court was made by S.M.SUBRAMANIAM, J.) The Contempt Petition has been instituted to punish the respondents for their willful disobedience of the orders of this Court dated 10.06.2025 passed in W.P.(MD).No.10374 of 2025.

2. This Court passed final orders as under:

"5.In the present case, a dispute exists amongst the Bar members of the Nanguneri Bar Association. The Writ Petition came to be instituted and an Advocate Commissioner was appointed without remuneration. The Advocate Commissioner has now withdrawn from the assignment. Election notifications are yet to be issued.

6.In view of the above, the first respondent/Bar Council of Tamil Nadu and Puducherry is directed to appoint an Election Commissioner/s for conducting the election for the Nanguneri Bar Association. The election shall be conducted within a period of eight weeks from the date of receipt of a copy of this order.

7.Accordingly, this Writ Petition stands disposed of. There shall be no order as to costs. Consequently, connected Miscellaneous Petition is closed."

Since the Nanguneri Bar Association is a recognized Bar Association by the Bar Council of Tamil Nadu and Puducherry, this Court directed the Bar Council of Tamil Nadu and Puducherry to appoint an Election Commissioner and conduct election within a period of eight weeks. In compliance with the orders of this Court, the Bar Council of Tamil Nadu and Puducherry appointed Election Commissioners, who in turn, conducted election on 01.08.2025 and declared the results. Newly elected office bearers have taken charge.

4. The petitioner states that he is a member of the Nanguneri Bar Association. The petitioner states that as per the interim orders passed in the writ petition, the voters list was not properly followed. If at all any election dispute exists, the petitioner ought to have approached the competent civil Court to adjudicate the issue. Contrarily, the contempt petition filed against

the final orders passed by this Court in W.P.(MD).No.10374 of 2025, dated 10.06.2025, has not been made out. This Court has not spoken anything about the voters list or the process to be followed by the Election Commissioners appointed by the Bar Council of Tamil Nadu and Puducherry. Therefore, the contempt is absolutely misconcieved. The petitioner, being a senior lawyer, practising in the Bar for about 25 years, though aware of these procedures, have filed this contempt petition unnecessarily.

5. Thus, the contempt petitoin is treated as frivolous and vexatious. Accordingly, the contempt petition stands dismissed. No costs. [S.M.S.,J.] & [A.D.M.C.,J.] 05.08.2025 NCC : Yes / No Index : Yes / No Internet : Yes PKN
