O R D E R

This writ petition has been filed seeking the issuance of a writ of mandamus, directing the respondents 1 to 4 to take appropriate action to conduct survey and to sub-divide the property of the petitioner in Survey No.630/3A of Palayakottai Village, Manapparai Taluk, Trichy District.

2. Heard the learned counsel for the parties and perused the materials available on record.

3.The learned counsel appearing for the petitioner submits that a representation dated 02.02.2023 was made seeking survey and subdivision of the property in question. Since no action has been taken by the respondents, the present writ petition has been filed.

4. The learned Additional Government Pleader appearing for the respondents submits that the petitioner was already informed to produce 2/5

necessary documents on 29.08.2023 in related to the subject property. However, the same has not been produced by the petitioner. Furthermore, the subject property is the classified as 'Sarkar Poramboke' and hence, it could not be surveyed. However, since a representation has been made by the petitioner, the same will be disposed of in accordance with Sections 9 and 10 of the Tamil Nadu Land Survey and Boundaries Act, 1923.

Recording the above submissions, this Court directs the fourth respondent to consider and dispose of the petitioner's representation dated 02.02.2023 on merits, after conducting an inquiry in accordance with Sections 9 and 10 of the Tamil Nadu Land Survey and Boundaries Act 1923, within a period of twelve weeks from the date of receipt of a copy of this order.
