ORDER : The Court made the following order :- The petitioners, who apprehend arrest at the hands of the respondent police for the offences punishable under Sections 61(2), 318(3), 318(4) and 351(3) of BNS, 2023 in Crime No.19 of 2025 on the file of the respondent police, seek anticipatory bail.
2. The case of the prosecution is that the petitioners herein are said to have cheated the de facto complainant by issuing three blank cheques for a sum of Rs.12,32,156/- and executing a promissory note in favour of the complainant. Hence, the complaint.
3. Heard the learned counsel appearing for the petitioners and the learned Government Advocate (Criminal Side) appearing for the respondent police.
4. This Court, by order dated 27.11.2025, directed the petitioners to deposit a sum of Rs.15,00,000/- to the credit of the crime number before the concerned Court. It is further submitted that, upon 2/7
reconciliation, the petitioners are liable to pay only a sum of Rs. 12,32,000/-. Considering the same, this Court directed the petitioners to deposit a sum of Rs.3,00,000/-, and the said direction has been duly complied with.

Considering the facts and circumstances of the case and also considering the fact that the petitioners have complied with the earlier condition imposed by this Court and that they are ready and willing to deposit a further sum of Rs.3,00,000/- to the credit of Crime Number to meet the ends of justice, this Court is inclined to grant anticipatory bail to the petitioners, subject to certain conditions.

Accordingly, the petitioners are ordered to be released on bail in the event of arrest or on their appearance, on condition that the petitioners shall execute a bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) each with two sureties each for a like sum to the satisfaction of the learned Judicial Magistrate No.II, Dindigul District within a period of fifteen days from the date on which the order copy is made ready and on further conditions that:

[a] the petitioners and the sureties shall affix their photographs and left thumb impression in the surety bond and the Magistrate may obtain a copy of their Aadhaar card or bank pass book to ensure their identity; (b) the petitioners shall deposit a sum of Rs.
3,00,000/- (Rupees Three Lakhs only) to the credit of the Crime No.19 of 2025 on the file of the learned Judicial Magistrate No.II, Dindigul District, and on such deposit being made, the learned Judicial Magistrate shall accept the sureties furnished by the petitioners and learned Judicial Magistrate shall deposit the said amount in an interest bearing Fixed Deposit in any nationalized Bank initially for a period of one year and renew them periodically until the final order / judgment is passed in the case in Crime No.19 of 2025. The Trial Court shall decide the entitlement to the deposit amount at the time of passing the final order or judgment;

[b] the petitioners shall report before the respondent Police daily at 10.30 am for a period of two weeks and thereafter, as and when required for interrogation;
[c]the petitioners shall not tamper with the evidence or witness either during investigation or trial. [d]the petitioners shall not abscond either during investigation or trial.
[e]On breach of any of the aforesaid conditions, the learned Magistrate/Trial Court is entitled to take appropriate action against the petitioners in accordance with law as if the conditions have been imposed and the petitioners are released on bail by the learned Magistrate/Trial Court himself as laid down by the Hon'ble Supreme Court in P.K.Shaji vs. State of Kerala 5/7

[f]If the accused thereafter absconds, a fresh FIR can be registered under Section 269 of BNS.
