ORDER : The Court made the following order :- The petitioner apprehending arrest at the hands of the respondent police for the offences punishable under sections 506(i) I.P.C., 376(AB) of IPC and 3(a) r/w. 4 , 5(m) r/w. 6 & 16, 17 of POCSO Act, 2012 and 9 and 11 of Child Marriage Act, 2006, in Crime No.17 of 2022 on the file of the respondent police, seeks anticipatory bail.
2.The case of the prosecution the petitioner performed the marriage for her minor daughter with the 1st accused and hence, the complaint has been lodged by the defacto complainant, who is the Extension Officer Women (E.O.) Social Welfare, Block Development Office, Madavar Valagam, Srivilliputur, Virudhunagar District. 3.The learned counsel appearing for the petitioner submitted that without knowing the petitioner, A1 married her daughter and she has no way connected with the offence and her name has been falsely implicated in this case.
4.The learned Government Advocate (Crl. Side) appearing for the respondent police would submit that the victim girl is only aged about 11 years. He would further submit that as per 164 statement of https://www.mhc.tn.gov.in/judis 1/2

No.16873 of 2022 the victim, the petitioner herein is only performed her marriage and the investigation of the case is pending. 5.Considering the serious nature of offence committed by the petitioner and that the victim is only aged about 11 years, this Court is not inclined to grant anticipatory bail to the petitioner. 6.Accordingly, this Criminal Original Petition is dismissed. sd/- 20/09/2022 / TRUE COPY / /09/2022 Sub-Assistant Registrar (C.S.)
