PETITION FOR ANTICIPATORY BAIL Under Section 438 of Cr.P.C. PRAYER :- For Anticipatory Bail in Crime No.441 of 2021 on the file of the Respondent police.
ORDER : The Court made the following order :- The petitioner/accused, who apprehends arrest at the hands of the respondent police for the offences punishable under Section 174 Cr.P.C. altered into Sections 294(b), 324 and 306 of IPC, in Crime No.441 of 2021, on the file of the respondent police, seeks anticipatory bail.
2. The case of the prosecution is that the petitioner and the deceased are friends for the past 8 years, that on 13.12.2021 at about 01.15 p.m., the deceased contacted his sister over phone and informed her that he is not willing to live as the petitioner attacked his father and scolded his mother and then subsequently, he consumed poison and committed suicide. Hence, the complaint.
3. When the matter is taken up for hearing today, the learned Government Advocate (Criminal side) would submit that the respondent police, after completing the investigation, has laid the charge sheet and the same was taken on file in P.R.C.No.304 of 2022 and that the jurisdictional Magistrate has issued summons for the appearance of the accused/present petitioner herein. https://www.mhc.tn.gov.in/judis 1/2

4. Since the learned Magistrate has already issued summons, the question of granting anticipatory bail does not arise at all. The petitioner is at liberty to appear before the concerned Magistrate and if required, he shall execute a bond as directed by the learned Magistrate.
