..Respondent Prayer: Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a writ of Mandamus directing respondent to assess the correct electricity consumption charges, to the service connection number 277-001-1657 in Thangam Steel rolling mill situated at Oomanthur Village, Trichy District for the period from 01.02.2018 to 21.06.2018 as contemplated in Rule 11 (2) (3) of the Tamil Nadu Electricity Supply Code 2004 and consequently to direct the respondent to repay the penalty amount collected from the petitioner for the defective meter and excess supply.

ORDER

This writ petition has been filed seeking a Writ of Mandamus directing the respondent to assess the correct electricity consumption charges for Service Connection No. 277-001-1657 in Thangam Steel Rolling Mill, located at Oomanthur Village, Trichy District, for the period from 01.02.2018 to 21.06.2018, in accordance with Rule 11(2) and 11(3) of the Tamil Nadu Electricity Supply Code, 2004. The petitioner also seeks a consequential direction to refund the penalty amount and excess charges collected due to a defective meter.

2. The learned standing counsel for the respondent submitted that, subsequent to the filing of this writ petition, the defective meter has already been replaced.

3. The learned counsel for the petitioner submitted that the only remaining issue is the refund of the excess consumption charges and penalty collected based on the defective meter.

4. In view of the above submissions, this writ petition is disposed of with the following directions:

The petitioner shall submit a detailed representation to the respondent seeking refund of the excess electricity charges and penalty within a period of two weeks from the date of receipt of a copy of this order. Upon receipt of such representation, the respondent shall consider and decide the same within a further period of two weeks, after affording an opportunity of hearing to the petitioner.
