..Respondents Prayer: Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue Writ of Mandamus to direct the respondents to grant Patta in Petitioner name for old Natham Survey No.1390, Re-Natham Survey No.2234/7 and as per Patta No.1270, New Natham Survey No. 2231/12 to the extent of 1320 sq.ft. of land situated at Vadaveeranaickenpatty village, Theni District within the time limit that may be stipulated by this Court.

ORDER

The writ petition is filed seeking a direction to the respondents to grant Patta in the petitioner's name in respect of the property situated in Old Natham Survey No.1390, Re-Natham S.No.2234/7 and as per patta No. 1270, New Natham S.No.2231/12 with an extent of 1320 sq. ft. of land situated at Vadaveeranaikenpatti Village, Thani District within the time stipulated by this Court.

2. Heard the arguments of Ms.G.Shabna learned counsel appearing for the petitioner and Mrs.K.Malathi, learned Additional Government Pleader who took notice for the respondents. By consent of both sides, this writ petition is taken up for final disposal at the admission stage itself.

3. It is seen that the subject property was purchased under SARFAESI proceedings, and the sale certificate was issued in favour of the petitioner on 28.10.2024. The said certificate was also filed before the registering authority. Later, the petitioner submitted a representation before the second respondent on 13.01.2025, seeking issuance of patta for the property situated in Survey No.2231/11, on the ground that the property purchased by the petitioner lies in Natham Survey No.2231/11. However, in the sale certificate issued in favour of the petitioner, the Natham Survey Number is mentioned as 2231/12. In such circumstances, the petitioner's request for 2/4

issuance of patta in respect of Natham Survey No.2231/11 cannot be directed to be considered. However, if the petitioner is satisfied with the issuance of patta in respect of Survey No.2231/12, as mentioned in his sale certificate, it is for him to file an appropriate online application seeking issuance of patta. If any such application is filed, the same shall be considered by the third respondent in accordance with law.

4. With these clarifications, this writ petitioner stands disposed of. No costs.
