ORDER : The Court made the following order :- The petitioner/Accused, who apprehends arrest at the hands of the respondent police for the offence punishable under Sections 8(c) & 20(b)(ii)(B) of NDPS Act, in Crime No. 553 of 2021, seeks anticipatory bail.

2.The case of the prosecution is that the accused persons were found in illegal possession of 2.600kgs of contraband namely Ganja. Hence, the complaint.

3.The learned counsel for the petitioner would submit that the petitioner is innocent and not committed any offence as alleged by the prosecution. He would further submit that a false case has been foisted against the petitioner. Hence, he seeks for anticipatory https://hcservices.ecourts.gov.in/hcservices/

4.The learned Additional Public Prosecutor would submit that when the police party was on patrol duty, they found the presence of four persons including the petitioner herein and on seeing the police, A2 and A4 ran away from that place and that A1 and A3 were secured and 2.250kgs of Ganja has been recovered from them. He would further submit that the first accused gave a specific confession, implicating the presence of other two accused, including the petitioner herein.

5.Considering the seriousness and gravity of offence and also the fact that A1 and A3 are still in judicial custody and considering the quantity of contraband seized and that the investigation is pending, this Court is not inclined to grant anticipatory bail to the petitioner. Accordingly, this Criminal Original Petition is dismissed.
