ORDER : The Court Made the following order :- The petitioners are arrayed as accused Nos.1 & 2, who were arrested and remanded to judicial custody on 17.05.2016 for the alleged offences punishable under Sections 392 r/w 397 and 506(ii) of IPC, in Crime No.115 of 2016, on the file of the respondent police and hence, seeks bail.

2.The case of the prosecution is that on 17.05.2016 at 5.00 a.m., while the defacto complainant was going to SIPCOT by walk, the petitioners waylaid the defacto complainant and threatened him at knife point and demanded money for procuring liquor and taken Rs.520 from his pocket. On complaint, case has been registered for the above said offences.

3.The case of the petitioners is that the petitioners are innocent and they have not committed any offences as alleged by the prosecution. They were well known persons to the defacto complainant. Due to previous enmity, the defacto complainant has given a false complaint against the petitioners. 4.The learned Government Advocate(Crl.side) submitted that the investigation is pending and there is no previous case against the petitioners.

5.Considering the facts and circumstances of the case and also considering the fact that the petitioners are in judicial custody from 17.05.2016, this Court is inclined to enlarge the petitioners on bail with certain conditions.

Accordingly, the petitioners are ordered to be released on bail and on each of them executing a bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) with two sureties each for a like sum to the satisfaction of the learned Additional District Munsif-cum-Judicial Magistrate, Manamadurai and on further condition that the petitioners shall appear before the respondent police daily at 10.00 a.m., until further orders.
