PRAYER :- For Bail in Crime no.241 of 2023 on the file of the Respondent Police. ORDER : The Court made the following order :- The petitioner/Sole Accused herein, who was arrested on 30.07.2023 for the alleged offence under Sections 294(b), 323, 324, 307 and 506(ii) of IPC, in Crime No.241 of 2023, on the file of the respondent police, seeks bail. 1/4
2.The case of the prosecution is that due to previous enmity over a issue regarding dog, on 30.07.2023 the petitioner assaulted the defacto complainant, thereby, he sustained injuries. Hence, the complaint. 3.The learned counsel for the petitioner submitted that the petitioner is an innocent person and she has not committed any offence as alleged by the prosecution.
4.The learned Additional Public Prosecutor submitted that there is seven previous cases against the petitioner. Out of which, five cases have been disposed of. 5.The learned counsel for the petitioner submitted that the above said five cases ended in acquittal.
6.Earlier, the learned Additional Public Prosecutor was required to verify as to whether history sheet was opened against the petitioner. He would submit that so far no history sheet was opened in respect of the petitioner. 7.Considering the above said submissions of the learned Additional Public Prosecutor and the period of incarceration, this Court is inclined to grant bail to the petitioner with stringent conditions.
8.Accordingly, this Criminal Original Petition is allowed and the petitioner is ordered to be released on bail, on executing a personal bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) with two sureties each for a like sum to the 2/4
satisfaction of the learned Judicial Magistrate, Nanguneri and on further condition that the petitioner shall report before the respondent police daily at 10.30 a.m. until further orders.
