ORDER

This writ petition has been filed challenging the impugned communication issued in respect of Application No.TR1076393212124 dated 20.11.2024 issued by the first respondent and for a consequential direction to the first respondent to renew the petitioner's passport in passport No.Y6618741.

2. The petitioner has submitted an application for renewal of passport after the petitioner's passport bearing No.Y6618741 expired on 09.08.2024. In the meantime, FIR was registered in Crime No.911 of 2020 before the third respondent police station on 17.05.2020 for offences under Section 147, 148, 294(b), 232, 234, 506(2), 307 of the IPC and Section 3(1) of the Prevention of Damage to Public Property Act, 1984. In the said FIR, the petitioner is not an accused person. The said complaint was lodged by one Natarajan 2/5

S/o.Ramachandran, Kudiyana Street, Malaiyur, Kodavasal Taluk.

3. Subsequently, another complaint was lodged by one Soorya, S/o.Sankar, and FIR was registered on 17.05.2020 in Crime No.912 of 2020 for offences under Section 294(b), 323, 506(1) of the IPC, Section 3(1)(r), 3(1)(s), 3(2)(va) of the SC/St (Prevention of Atrocities) Act, 1989.

4. The learned Government Advocate for the third respondent submits that the petitioner has been arrayed as Accused No.2 in Crime No.912 of 2020 and a charge sheet has been filed and take on file before the learned Special Judge for SC/ST cases, Thiruvarur, in Special S.C.No.37 of 2020.

5. Considering the same, there is no scope for issuing a direction to the first respondent to process the petitioner's passport application.

6. Since the petitioner's passport application has already been rejected on 20.11.2024, it is open to the petitioner to file a fresh application after obtaining suitable order from the concerned Court for processing the petitioner's fresh passport application.

7. The writ petition stands disposed of. No costs. Consequently, the connected miscellaneous petition is closed.
