Respondent/Respondent/ Complainant PRAYER: Criminal Revision Case, filed under Section 397 and 401 of the Criminal Procedure Code, to call for the records pertaining to the order of dismissal in C.A.No.15 of 2012, dated 21.11.2014, passed by the learned V Additional District and Sessions Judge, Madurai, in confirming the conviction and sentence imposed by the learned Judicial Magistrate at Melur in S.T.C.No.710 of 2009 on 27.02.2012 and set aside the same.

ORDER

This Criminal Revision Case has been filed against the Judgment dated 27.02.2012, passed by the learned Judicial Magistrate, Melur, Madurai District in S.T.C.No.710 of 2009, wherein, the petitioner was convicted for the offence punishable under Section 138 of the Negotiable Instruments Act and sentenced to undergo one year Simple Imprisonment and to pay a fine of Rs.5,000/-, in default, to undergo three months Simple Imprisonment.

2. Today, when the matter is taken up for hearing, learned counsel appearing on either side submitted that the dispute between the petitioner and the complainant has been settled amicably and a sum of Rs.2,50,000/- was settled by the petitioner in favour of the respondent and that was also received by the respondent towards final settlement of dispute and the respondent has no objection in allowing this revision petition. It is further submitted that a compromise memo has also been filed to that effect, wherein, both the parties as well as their respective counsel also signed.

3. A copy of the compromise memo has also been filed before this Court.

4. Recording the submissions made by the learned counsel appearing on either side, this Criminal Revision Case is allowed. The accused in this case is acquitted of the charge under Section 138 of the Negotiable Instruments Act. The compromise memo shall form part of the order.
