Mr.B.Nambiselvan Additional Public Prosecutor PETITIONS FOR ANTICIPATORY BAIL Under Sec.438 of Cr.P.C PRAYER :- For Anticipatory Bail in Crime No.266 of 2023 on the file of the Respondent police.

ORDER : The Court made the following order :- The petitioner/ Accused herein, apprehending arrest at the hands of the respondent police for the offences punishable under Sections 406 and 420 of IPC in Crime No.266 of 2023, on the file of the respondent police, seeks anticipatory bail.

2. The case of the prosecution is that the accused Nos. 1 and 2 were doing vegetable business and the defacto complainant and others have invested 1/3

Rs.66,31,500/- through Bank transaction and through Phone pay to the second accused from 01.06.2020 till 13.05.2022 to join in the business as a partner. The petitioner and the other accused persons were paying the share to the defacto complainant and others and for the past 14 months, no share or profit has been paid to the defacto complainant and he could not even contact the accused persons. Hence the complaint.

3. The learned counsel for the petitioner would submit that the petitioner is an innocent, he has been falsely implicated in this case and he has not committed any offences as alleged by the prosecution.

4. The learned Additional Public Prosecutor would submit that the petitioner is already in custody since 14.08.2023 for the offences under Sections 406, 420 and 506(ii) of IPC in Crime No.565 of 2023.

5. Considering the submissions, this is Court is not inclined to entertain this petition and the petitioner can revive the application after his arrest.
