ORDER

The Criminal Original Petition has been filed seeking orders to quash the FIR in Crime No.115 of 2024 pending on the file of the first respondent.

2. It is not in dispute that on the basis of the complaint given by the second respondent, FIR came to be registered in Crime No.115 of 2024 on 28.06.2024 for the offences under Sections 147, 294(b), 324 and 506(2) IPC against the petitioners and that on the basis of the complaint given by the second petitioner, FIR came to be registered in Crime No. 116 of 2024 on 28.06.2024 for the offences under Sections 147, 294(b), 324, 354 and 506(2) IPC against 6 named persons including the second respondent.

3. The learned counsel appearing for the petitioners as well as the learned Government Advocate (Criminal Side) appearing for the first respondent would admit that both the cases are case and case in counter.

4. The learned Government Advocate (Criminal Side) appearing for the first respondent would submit that in both the cases, six witnesses were examined and investigation are pending.

5. Since it is a case and case in counter, the first respondent is directed to follow the direction issued by the Hon'ble Full Bench of this Court in Crl.O.P.Nos.4587 of 2023 (Batch) dated 08.08.2024.
