ORDER : The Court made the following order :- The petitioner/Accused, who apprehends arrest at the hands of the respondent police for the offence punishable under Sections 8(c) & 20(b)(ii)(B) of NDPS Act, in Crime No. 175 of 2021, seeks anticipatory bail.
2.The case of the prosecution is that the accused persons were found in illegal possession of 1.200kgs of contraband namely Ganja. Hence, the complaint.
3.The learned counsel for the petitioner would submit that the petitioner is innocent and not committed any offence as alleged by the prosecution. He would further submit that a false case has been foisted against the petitioner. Hence, he seeks for anticipatory https://hcservices.ecourts.gov.in/hcservices/

4.The learned Additional Public Prosecutor would submit that when the police personnel was in survilance duty, near Keeripatti village, they found the presence of two persons and on seeing the police party, one person ran away from that place and the other person, who is the mother of petitioner herein was arrested and 1.200kgs of contraband was seized from her. He would further submit that the other accused gave a confession implicating the presence of present petitioner.
5.Considering the seriousness and gravity of offence alleged against the petitioner and also the fact that the investigation is not yet completed, this Court is not inclined to grant anticipatory bail to the petitioner. Accordingly, this Criminal Original Petition is dismissed.
