ORDER : The Court made the following order :- The petitioners/ Accused apprehends arrest at the hands of the respondent police for the offences under Sections 406 and 420 of IPC in Crime No.Not known of 2023, on the file of the respondent police, seeks anticipatory bail. 1/3

The case of the prosecution is that on seeing an advertisement, the defacto complainant applied for a catering job in Russia in the petitioner's company and paid a sum of Rs.6,00,000/- and handed over his passport to them. Thereafter he came to know that the petitioner's company has given a forged passport to him and cheated him. When he went to question the company about this issue, the company was found closed. Hence the complaint.

3. The learned counsel for the petitioner submitted that the petitioner is an innocent, he has been falsely implicated in this case and he has not committed any offence as alleged by the prosecution.

4. The learned Additional Public Prosecutor would submit that on the ground that a complaint on a similar subject was registered in Crime No.39 of 2022 on the file of the Aavadi Central Crime Branch, this petition has been filed. The petitioner was called upon to attend the enquiry.

5. According to the learned counsel for the petitioner, he was granted regular bail after arrest, by the learned Principal District and Sessions Judge, Tiruvallur, in Cr.M.P.No.2274 of 2023 on 07.06.2023. After that the present complaint has been given by the respondent.

6. The learned counsel for the petitioner would submit that the petitioner was only an employee of the first accused who is the owner of the travel agency. Apart 2/3

from that he has no connection with the company.

7. Let the petitioner appear before the respondent since numerous complaints have been given to the respondent. During the course of enquiry, if any trouble arises, the petitioner is at liberty to work out the remedy.
