ORDER : The Court made the following order :- The petitioners/ Accused apprehends arrest at the hands of the respondent police for the offences under Sections 294(b) of IPC and Section 25(1A) of Arms Act, 1/4
in Crime No.55 of 2023, on the file of the respondent police, seeks anticipatory bail.
2. The case of the prosecution is that on 28.07.2023, when the respondent police was on patrol duty, the petitioner was riding a motor cycle with a sack. The sack was recovered and the petitioner found in possession of two knife and one aruval. The property was recovered and a case was registered.
3. The learned counsel for the petitioner would submit that the petitioner is an innocent, he has not committed any offence as alleged by the petitioner. He has been falsely implicated in this case.
4. Learned Government Advocate (Crl.side) would submit that there are three accused in this case. The petitioner is not having any previous cases.
5. Considering the facts and circumstances of this case and also the fact that the petitioner is not having any previous case except this case, this Court is inclined to grant relief to the petitioners.
6. Accordingly, this Criminal Original Petition is allowed and the petitioner is ordered to be released on bail in the event of arrest or on his appearance, before the learned Judicial Magistrate, Thiruvaiyaru, Thanjavur District, on condition that the petitioners shall execute a bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) each with two sureties each for a like sum to the satisfaction of the learned Magistrate concerned and the petitioner shall appear before the respondent police 2/4
daily at 10.30 a.m., until further orders. The petitioner shall comply with the condition stipulated under Section 438 of Cr.P.C., scrupulously.
7.
