ORDER

This Criminal Original Petition has been filed seeking a direction to the learned Judicial Magistrate No.II, Dindigul, to expedite and dispose of the trial in C.C.No.72 of 2010 within a time frame to be stipulated by this Court.

2. The grievance of the petitioner is that the trial in C.C.No.72 of 2010 on the file of the learned Judicial Magistrate No.II, Dindigul, has not progressed since 2015.

3. The learned Government Advocate (Crl. Side) submitted that the case in C.C.No.72 of 2010 was registered against the sole accused, one Kamaludeen, who unfortunately passed away on 28.01.2014.

4. It is indeed unfortunate that the respondent Police had not intimated the death of the accused to the concerned Judicial Magistrate, and the learned Judicial Magistrate has been mechanically adjourning the case for issuance of fresh summons. The respondent Police is therefore directed to formally intimate the death of the accused to the concerned learned 2/4

Judicial Magistrate forthwith.

5. Since the sole accused in C.C.No.72 of 2010 has died, nothing survives for further adjudication in this Criminal Original Petition.
