ORDER
This writ petition has been filed for issuing a Writ of Mandamus, directing the Respondent No.1 to consider and pass order on the petitioner's Second Appeal, dated 14.10.2015 preferred under Section 19(3) of the Right to Information Act, 2005, within the time stipulated by this Court.
2.The learned counsel appearing for the first respondent produced before this Court the Check slip, dated 23.11.2015, issued to the petitioner by the Assistant Registrar. It is stated that the https://hcservices.ecourts.gov.in/hcservices/ 1/2
W.P.(MD).No.19095 of 2015 second appeal preferred by the petitioner on 14.10.2015 was returned for certain compliance as the appeal was presented without furnishing certain documents which are required to proceed with the appeal. It is further stated that the petitioner did not represent the appeal thereafter. Since the appeal is stated to have been returned by the first respondent's office on 23.11.2015 itself, the appeal is not pending as on date.
3.Recording the said statement, this Court is of the view that no further adjudication is required. Hence, this writ petition is closed as infructuous. No costs. However, it is open to the petitioner to represent the appeal and prosecute.
