Respondents Prayer: Writ Petition filed under Article 226 of the Constitution of India, praying for issuance of Writ of Certiorarified Mandamus, to call for the records Letter No. EE / N / DGL / TA / F.Theft / D.No.917/2017 dated 20.10.2017 on the file of the 2nd respondent to quash the same and consequently direct the 2nd respondent to refund the amount of Rs. 4,81,604/- (Rupees Four Lakhs Eighty One Thousand Six Hundred and Four only) and Rs.36,000/- (Rupees Thirty Six Thousand only) being

collected toward compounding fees.

ORDER

The present writ petition is filed for the following relief : "to call for the records Letter No. EE / N / DGL / TA / F.Theft / D.No.917/2017 dated 20.10.2017 on the file of the 2nd respondent to quash the same and consequently direct the 2nd respondent to refund the amount of Rs.4,81,604/- (Rupees Four Lakhs Eighty One Thousand Six Hundred and Four only) and Rs.36,000/- (Rupees Thirty Six Thousand only) being collected toward compounding fees."

2. Without going into the merits of the case, considering the fact that the impugned order has been passed without affording a personal hearing to the petitioner which is evident from reading of the impugned order, the impugned order, dated 20.10.2017 is set aside and the matter is remitted back to the file of the 2nd respondent for considering the same afresh and passing speaking orders, after giving an opportunity of

personal hearing to the petitioner. The said exercise shall be completed within a period of two (2) months from the date of receipt of copy of this order.

3. With the above direction, this Writ Petition stands disposed of. No costs.
