BEFORE THE MADURAI BENCH OF MADRAS HIGH COURT DATED:23.11.2021

CORAM:

THE HONOURABLE DR.JUSTICE ANITA SUMANTH W.P.(MD).No.13385 of 2018 and W.M.P(MD).No.12198 of 2018 Tmt.M.Sakthi ... Petitioner vs.

1.The Zonal Manager, Madurai Zonal, Zonal Office Campus, No.2, Dr.Ambedkar Road, Near Raja Muthaiah Mandram, Madurai 625 002.

2.The Regional Manager, Tirunelveli Region, Regional Office Campus, No.25, S.N.High Road, Tirunelveli City, Tirunelveli District 627 001.

3.Thiru.R.Manickam, ... Respondents PRAYER: Writ Petition is filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Mandamus, directing the respondents 1 and 2 to consider and also take proper and necessary action based on petitioner's representation, dated 04.06.2018.

For Petitioner : Mr.Praveen Kumar for Mr.A.S.Amirtharaj For R1 & R2 : Mr.Ananth C.Rajesh For R3 : Mr.B.Jameel Arasu

O R D E R

This writ petition has been rendered infructuous and is in fact misconceived. Heard Mr.Praveen Kumar, learned counsel for the petitioner and Mr.Ananth C.Rajesh, learned counsel appearing for the State Bank of India, Tiruneveli arrayed as R1 and R2. 1/3

2. The petitioner has prayed for a Mandamus directing respondents 1 and 2 to consider her representation, dated 04.06.2018, wherein she seeks intervention of the Bank to reject the application of R3, if and when filed, for voluntary retirement.

3. It is brought to the notice of this Court that R3 has superannuated on 30.04.2018 and thus, the question of voluntary retirement does not arise. Moreover, the petitioner's representation is vague and evidently, an effort to fish for information even without ascertaining whether R3 was yet in service.

4. Though there are other allegations in the writ affidavit, I am not inclined to delve into the same at this juncture. Suffice it to state that this writ petition is a gross abuse of process of this Court. Costs of a sum of Rs.5,000/- (Rupees Five Thousand only) is imposed upon the petitioner payable to the Advocates Relief Fund, Madurai Bench of Madras High Court, Madurai, within a period of four weeks from today.

5. Mr.Praveen Kumar, representing counsel appearing for the learned counsel for the petitioner will convey the above direction to the counsel on record for compliance by the petitioner, as aforesaid. This Writ petition is dismissed. No costs. Consequently, connected Miscellaneous Petition is closed.
