ORDER
This writ petition is filed seeking issuance of writ of mandamus forbearing the respondents respondents 2 and 3 from conducting survey of the property situated in Survey Nos.13/10, 13/10B, 13/10C, 13/10D and 13/10F, in Pullaneri Village, Usilampatti Taluk, Madurai District, till the disposal of the patta appeal pending before the first respondent on 26.05.2025, by considering the representation of the petitioner dated 14.07.2025 by this Court.
2.Heard the arguments of Mr.V.Selvakumar, learned counsel appearing for the petitioner and Mr.A.Baskaran, learned Additional
Government Pleader appearing for the respondents 1 to 3. By consent of both sides, this Writ Petition is taken up for final disposal at the admission stage itself.
3. It is the case of the petitioner that one Pachiammal and six others obtained patta in respect of the subject property by producing invalid documents. Therefore, the petitioner filed an appeal before the first respondent on 26.05.2025. While the patta appeal was pending on the file of the first respondent, the above mentioned persons moved the respondents 2 and 3, seeking survey of the subject property. Therefore, the instant writ petition has been filed by the petitioner. 4.When the matter is taken up for hearing, the learned Additional Government Pleader, who takes notice for the respondents, would submit that the subject property was already surveyed at the instance of Pachiammal and others.
5.In view of the said submission made by the learned Additional Government Pleader, no further orders are required in this writ petition.
However, it is made clear that mere survey by the respondents would not affect the persons in lawful possession of the subject property and his title, if any, over the subject property.
6.With this clarification, this Writ Petition stands disposed of. No costs.
