Respondent PRAYER :- This Criminal Original Petition has been filed under Section 483(1)(b) of BNSS and Section 439(1)(b) of Cr.P.C., to modify the condition No.2 i.e., the petitioner should surrender before the learned Judicial Magistrate No.IV, Madurai on 10.09.2024 imposed in the bail order in Crl.M.P.No.2989 of 2024, dated 07.08.2024. ORDER
This Criminal Original Petition has been filed to modify the condition No.2 i.e., the petitioner should surrender before the learned Judicial Magistrate No.IV, 1/3
Madurai on 10.09.2024 imposed in the bail order in Crl.M.P.No.2989 of 2024, dated 07.08.2024.
2. Heard the learned counsel for the petitioner and the learned Government Advocate (Crl.side) appearing for the respondent Police.
3. From the nature of the order it can be seen that interim bail for a period of one month is granted. While keeping the petition pending, the grievance expressed by the learned counsel for the petitioner is that even though a reasonable sum as due is offered by the petitioner, the other side is not willing to settle. Be that as it may, the court has only granted interim bail for a period of 30 days so as to enable both parties to settle the issue, if the parties are unable to settle the issue on the said date, it is open for them to argue before the same Court and this petition is not entertained before this Court.
4. With the above observation, this Criminal Original Petition is disposed of. sd/- 03/09/2024 / TRUE COPY / / 10 /2024 Sub-Assistant Registrar (C.S. I / II / III / IV) Madurai Bench of Madras High Court, Madurai - 625 023.
