ORDER : The Court made the following order :- The petitioners/Accused No.3, apprehending arrest at the hands of the respondent police for the alleged offence punishable under Section 379 of Indian Penal Code, 1860, in Crime No.90 of 2023, on the file of the respondent police, seeks anticipatory bail.

2. The case of the prosecution is that in a drunken mood, the petitioner along with the other accused stolen the defacto complainants's uncle bike. Hence, the case.

3. The learned counsel for the petitioner submits that the petitioner is an innocent person and he has not committed any offence as alleged by the prosecution. He further submitted that due to previous enmity, the present complaint has been given by the defacto complainant.

4. The learned Government Advocate(Crl.Side) appearing for the respondent police submitted that the petitioner is having two previous cases. He further submitted that the property has been recovered on the basis of confession statement of the the first accused.

5. Considering the facts and circumstances of this case and also considering the bad antecedents of the petitioner, this Court is not inclined to grant anticipatory bail to the petitioner.
