ORDER

Heard the learned counsel on either side.

2. The revision petitioner Pandi is the complainant in S.T.C.No.570 of 2013 on the file of the Judicial Magistrate No.I, Fast Track Court at Magisterial Level, Madurai.

3. The case ended in conviction and sentence. Aggrieved by the same, the respondent herein filed C.A.No.42 of 2014 before the IV Additional District and Sessions Judge, Madurai. The appellate Court by Judgment dated 18.04.2016 came to the conclusion that the complainant failed to prove the execution of the cheque and there was no legal enforceable debt and that the cheque in question was not issued towards discharge of the debt. In that view of the matter, the appeal was allowed and the Judgment of the Court below was set aside and the accused was acquitted. Challenging the same, the complainant filed this criminal revision case.

4. The formal submission of the respondent's counsel is that the complainant is no more. The learned counsel appearing for the respondent also states that in spite of his best efforts, he could not contact with the revision petitioner, it is only the respondent who is before this Court and not the complainant.
