O R D E R

[Order of the Court was made by G.K.ILANTHIRAIYAN, J.] Seeking to suspend the sentence imposed on the petitioner by the V Additional District and Sessions Court, Madurai, vide Judgment dated 28.04.2025 in S.C.No.186 of 2017, the present Criminal Miscellaneous Petition has been filed.

2. Heard the learned counsel on either side and perused the materials available on record.

3. The learned counsel appearing for the petitioner would submit that the second accused was granted bail and the petitioner herein being the first accused is also standing in the same footing, thereby he would seek to suspend the sentence as against the petitioner.

4. A perusal of the record reveals that the petitioner herein has caused stab injuries on the deceased and only because of that injuries the deceased died.

5. The petitioner has failed to make out a prima facie case for grant of suspension of sentence, hence we are of the opinion that it is not a fit case for grant of suspension of sentence to the petitioner.

6. Accordingly this Criminal Miscellaneous Petition stands dismissed.
