Respondents Prayer: Writ Petition filed under Article 226 of the Constitution of India, for the issuance of Writ of Mandamus, directing the respondents to rectify the petitioner's daughter Shahrin Banu father's name as Alavudeen instead of Haja Alavudeen in the School Transfer Certificate by considering the petitioner's representation, dated 15.10.2015 within the time period stipulated by this Court.

ORDER

This writ petition is filed for issuing a writ of Mandamus directing the respondents to rectify the name of the father as 'Alavudeen' in stead of 'Haja Alavudeen' in the petitioner's daughter's school Transfer Certificate.

2. The petitioner's case is that her husband died and that his name is Alavudeen. It is her case that her daughter is studying in Kader Mohaideen Girls Higher Secondary School, Athiramapattinam. The petitioner states that she noticed that the name of father of petitioner's daughter has been wrongly given as 'Haja Alavudeen' instead of 'Alavudeen' by mistake. The petitioner has stated that she had requested the School Administration earlier for changing the name of petitioner's husband in the School records like Transfer Certificate and Mark sheet, which had given to her daughter. Since the respondents have not considered the request of the petitioner, the petitioner has approached this Court. The petitioner has produced before this Court certain records to show that the name of the petitioner's husband is 'Alavudeen' and not 'Haja Alavudeen'. It is further stated that to avoid different names in all Certificates issued to the petitioner's daughter, the petitioner seeks the prayer.

3.Considering the facts and circumstances and since the learned counsel for the petitioner submitted that the petitioner will be satisfied if a direction is issued to the respondents to consider the petitioner's representation, without expressing any opinion on the merits of the petitioner's representation, this Court is inclined to issue the following direction. (i)The fourth and fifth respondents are directed to consider the representation of the petitioner, dated 15.10.2015 and pass appropriate orders on merits and in accordance with law within a period of eight weeks from the date of receipt of a copy of this order.

4.With the above directions, this writ petition is disposed of. No costs.
