No.A1/313/2023, dated 20.02.2023, within a time frame that may be stipulated by this Court and directing the respondent to pay the subsistence allowance for the period of suspension from 15.09.2023 to till the date of disposal in Department Enquiry.

O R D E R

The instant writ petition has been filed by a Supervisor of the TASMAC Shop, seeking a Mandamus to complete the Departmental Enquiry arising out of charge memo dated 20.02.2023 within the time frame.

2. On instructions, the learned Standing Counsel appearing for the respondent has submitted that the petitioner has submitted his reply only on 30.08.2024 and immediately thereafter, Enquiry Officer has been appointed on 05.09.2024. The Enquiry Officer has fixed the date of enquiry on 16.09.2024.

3. It is reported that the petitioner is under suspension from 15.09.2023 and the subsistence allowance has not been paid.

4. Considering the above said facts, the respondent herein is directed to disburse the subsistence allowance during the period of suspension from 15.09.2023, within a period of two weeks from the date of receipt of a copy of this order and to complete the Departmental Enquiry proceedings on or before 31.12.2024.

5. With the above said observations, this Writ Petition stands disposed of. There shall be no order as to costs.
