Prayer: Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Mandamus, directing the first respondent to renew the passport of the petitioner in File NO.MD 1075027367425 by considering the representation of the petitioner dated 22.07.2025 within the time stipulated by this Court.

ORDER

This writ petition has been filed for a writ of Mandamus, to direct the first respondent to renew the passport of the petitioner by considering the representation of the petitioner dated 22.07.2025.

2. The petitioner applied for renewal of a passport which is to expire on 25.04.2026. The renewal application of a passport was submitted in advance as the petitioner is working in Sinapore. However, the passport application has not been processed on account of the pendency of a criminal case against the petitioner and others in an FIR in Crime No.103 of 2019, dated 27.03.2019 before the second respondent Police Station for offences under Sections 147, 294(b), 323, 324, 506 (2) of the IPC.

3. The learned Government Advocate for the second respondent confirms that although the petitioner has been arrayed as Accused No.5 and a charge sheet has been filed before the Judicial Magistrate, Illankudi and the same has not been taken on file.

4. Considering the same, there can be no impediment in directing the first respondent to renew the petitioner's passport application.

Accordingly, the first respondent is directed to renew the petitioner's passport as expeditiously as possible preferably within a period of four weeks from the date of receipt of a copy of this order. The petitioner is directed to co-operate with the respondents, in case charge sheet is filed. The petitioner shall surrender the passport before the concerned court in case charge sheet is filed.

6. It is made clear that if the petitioner fails to appear before the Court after the summons are issued, it is open to the first respondent to take steps to cancel the passport. Independently, it is also open to the first respondent to cancel the passport and to expedite the petitioner for being present as and when the charge sheet is filed against the petitioner.
