PRAYER : Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Certiorarified Mandamus, to call for the records relating to the Cancellation of Gift Settlement Deed No.499 of 2015 dated 10.02.2015 registered in the office of the 4th respondent and quash the same and to direct the respondents 3 and 4 to pass orders on the representation of the petitioner dated 02.09.2015, by conducting enquiry with respect to the cancellation of gift deed dated 10.02.2015 and registered as document No.499 of 2015 by the 4th respondent for the property situated at Door No.3/68-A, T.Karisalkulam, comprised in Survey No.91/E measuring 3.5 cents and cancel the entry in the index.

ORDER

The present writ petition has been filed challenging the registration of unilateral cancellation of a settlement deed by the 5th respondent herein.

2. According to the learned counsel for the petitioner, the 5th respondent who is the mother of the petitioner had executed a registered 2/5

settlement in favour of the petitioner. However, the same was unilaterally cancelled by the 5th respondent on 10.02.2015.

3. The learned counsel for the petitioner submits that the 5th respondent has passed away and the petitioner is not responding to file legal heir petition for the 5th respondent herein.

4. According to the learned counsel for the petitioner, he has sent a registered post and there is no response from the writ petitioner. The 5th respondent alone is the contesting respondent in this writ petition. Since the 5th respondent has passed away and no steps have been taken, this Writ Petition stands closed with liberty to the writ petitioner to restore the same, if he is so advised. No costs. Consequently, connected Miscellaneous Petitions are closed.
