Respondents PRAYER: Writ Petition filed under Article 226 of the Constitution of India for issuance of Writ of Mandamus to direct the first respondent not to permit the respondents No.4 to 6 to change the nature of business of the third respondent in the premises of Plot No.C-63, SIPCOT Industrial Growth Centre, Gangaikondan, Tirunelveli District in contra to the Clause 17 of the Allotment order, dated 12.12.2016 without the consent of first respondent as per the communication of the second respondent in PO/SIP-GKN/Starcraft/2025, dated 18.07.2025 by considering the petitioner's representations dated 30.03.2024 and 17.07.2025. ORDER

This Writ Petition is disposed of at the time of admission with the consent of the learned counsel for the petitioner and learned Standing Counsel for the respondents 1 and 2.

2. It appears that the private respondents 4 to 6 are the partners of the third respondent/Firm of which the petitioner and the private respondents 4 to 6 are the partners holding equal shares.

3. The specific case of the petitioner is that a land was allotted by the official respondents 1 and 2 by an allotment order, dated 12.12.2016 bearing reference in Ref.No.D1/SIGC-GKN/Starcraft/2016.

4. It is submitted that as per the aforesaid allotment order, the constitution of the partnership firm cannot be changed without prior approval of the first respondent. The petitioner apprehends that the private respondents 4 to 6 are attempting to alter the constitution of the partnership firm and thus in violation of the allotment order.

In this connection, the petitioner has sent a representation, dated 30.03.2024 to the first respondent and another reminder, dated 17.07.2025 to which by a communication, dated 18.07.2025, the second respondent has directed the petitioner to take up the matter with the SIPCOT Head Office/first respondent for further action.

6. Considering the above, I am inclined to dispose of this Writ Petition after dispensing with the notice on the private respondents 3 to 6, as no adverse orders are proposed to be passed at this stage against any of the private respondents.

Suffice to state that the petitioner's representations, dated 30.03.2024 and 17.07.2025 shall be considered and disposed of by the first respondent taking note of the restrictive Clause in the allotment order, dated 12.12.2016 bearing reference in Ref.No.D1/SIGC-GKN/Starcraft/2016 allotting the plot to the third respondent.

8. This exercise shall be completed within a period of four (4) weeks from the date of receipt of a copy of this order, after due notice to the private respondents 3 to 6.

9. This Writ Petition is disposed of, with the above observations. No costs. Consequently, connected miscellaneous petition is closed. 4/6
