ORDER : The Court made the following order :- The petitioner/Accused No.2, apprehending arrest at the hands of the respondent Police for the alleged offence punishable under Sections 392 of I.P.C, in Crime 213 of 2023 on the file of the respondent Police, seeks anticipatory bail.
2. The case of the prosecution is that the petitioner along with other accused persons snatched eight sovereigns of gold chain from the defacto complainant and tried to ran away from the place of occurrence, however, when other came there to rescue, they left the chain and ran away. Hence, the complaint.
3. The learned counsel for the petitioner submitted that the petitioner is an innocent and is no way connected in this case. Further, the petitioner is the friend of first accused. When both of them drove the two wheeler in the defacto complainant's street, questioned the petitioner, due to that wordy quarrel arose between the petitioner and the defacto complainant. Hence, the false cae has been foisted against them.
4. The learned Government Advocate (Crl. Side) would submit that the petitioner is having two previous cases, which are not in similar nature. Further, 2/4
after completion of investigation, Charge Sheet has been filed, showing this petitioner as absconding accused before the learned Judicial Magistrate, Vadipatti.
5. Since the Charge Sheet has been filed before the concerned trial Court, let the petitioner appear before Judicial Magistrate, Vadipatti and seek regular bail. (*)6.
