ORDER

The Criminal Original Petition has been filed, invoking Section 1/4

528 B.N.S.S., seeking orders to direct the respondent police to expedite the investigation and file the final report in connection with Crime No. 386 of 2023 dated 15.12.2023 on the file of the respondent police.

2. When the matter is taken up for hearing today, the learned Government Advocate (Criminal Side) appearing for the respondent would submit that the respondent, after completing the investigation, has prepared the final report as 'Mistake of Fact' and RCS notice was served on the petitioner/defacto complainant on 10.01.2024 through post.

3. The learned counsel appearing for the petitioner would submit that they have not received any RCS notice.

4. Considering the above, the respondent is directed to serve RCS notice on the petitioner immediately and file the final report before the jurisdictional Court within a period of 15 days from the date of receipt of a copy of this order.

5. With the above direction, this Criminal Original Petition stands 2/4

disposed of. The petitioner is at liberty to file a protest petition, if so advised.
